Terms of Service

Effective: November 1, 2026

These Terms of Service ("Terms") govern use of tidepointmedia.com and the services provided by Tide Point Media LLC, a South Carolina limited liability company ("Tide Point Media," "we," "us," or "our"). You may contact us at delivery@tidepointmedia.com.

Services you order are governed by the version of these Terms you accept for that order, together with the applicable quote, order, and any written agreement between us. Please review the terms presented during booking. If you place an order for a business or another person, you represent that you have authority to do so.

1. Services and orders

We offer real estate and related media services that may include property photography, aerial photography and video, land and lot media, floor plans, video walkthroughs and showcases, 3D services, virtual staging, virtual twilight, editing, portraits, and headshots. Availability depends on the location, requested service, conditions, and scheduling. A listing of a service on our website does not guarantee that it will be available for every order.

Your accepted order or quote will identify the services and deliverables purchased, price, location, appointment, and any applicable travel charges, delivery estimates, or included revisions. A booking request or quote is not a confirmed appointment until we accept it and provide confirmation. We may use employees, contractors, and other providers to perform our services. Tide Point Media remains responsible for its obligations to you under your accepted order.

Changes to an accepted order, including additional services and charges, require your agreement and ours. If an order and these Terms conflict about the particular services, price, or other specific terms of that order, the order controls to the extent of the conflict. A change to these Terms on our website does not by itself change an order already accepted.

2. Prices and payment

Your order or quote will state the agreed price and any applicable sales tax, travel charge, or other disclosed fee. Payment is generally accepted in advance or at the appointment, unless we agree on a different schedule in the order. We will tell you the available payment methods when you book or pay. Additional services or charges require your agreement.

The license to use delivered media described below begins once your order is paid in full, unless we agree otherwise in writing. Paying for services does not transfer copyright or grant rights beyond those described in your agreement. If you have a payment concern, contact us at delivery@tidepointmedia.com.

If payment is overdue, we may withhold delivery or access until the amount due is paid, subject to applicable law. Contact us about a billing error; we will correct errors in our charges.

3. Cancellation, rescheduling, and access

You may cancel an appointment without a cancellation fee by notifying us at least 24 hours before its scheduled start. If you cancel or request to reschedule less than 24 hours before the scheduled start, we may charge a fee of up to 50% of the applicable appointment price. We may waive that fee.

Please have the property ready and provide access at the scheduled start. If the property is not ready or accessible within 30 minutes after the scheduled start and we must abandon the appointment, we may charge a fee of up to 50% of the applicable appointment price. Please tell us promptly if you anticipate an access or readiness problem so we can discuss options.

For these fees, the applicable appointment price is the agreed price, after applicable discounts and before sales tax, for the services scheduled for that appointment. It excludes unrelated appointments. We will refund any payment for the affected appointment that exceeds the fee and any agreed charges for services already completed, subject to applicable law. We will not charge both a fee and a completed-service charge for the same work. For a rescheduled appointment, you may instead choose to apply that refundable amount as a credit toward the newly agreed price. We will not both refund and credit the same amount or charge it twice. Applicable taxes, if any, will be handled as required by law.

We will not charge a cancellation, late-rescheduling, or no-access fee when we or our provider cannot perform, including because of our delay, weather, or flight restrictions. An appointment abandoned because the client did not provide access or a ready property is governed by the no-access provision above. We may waive a fee for an emergency or other circumstances outside your control. We will charge no more than one cancellation, late-rescheduling, or no-access fee for the same appointment. Contact us at delivery@tidepointmedia.com to request a cancellation or reschedule.

4. Weather, safety, and service interruptions

Weather, unsafe conditions, flight restrictions, access limitations, equipment problems, illness, or other circumstances can affect a service. Aerial services are subject to safe conditions and applicable flight rules and permissions. We will contact you if we cannot perform or complete a service as planned.

If we or our provider cannot provide part or all of the agreed service, you may choose to reschedule the affected service or receive a refund for the portion we cannot provide, unless we agree to another remedy. We may retain the agreed charge for services already completed. We will not charge a cancellation, late-rescheduling, or no-access fee when we or our provider cannot perform. Client-caused failure to provide access or a ready property is governed by Section 3.

5. Property access and preparation

You are responsible for providing accurate information about the project and arranging lawful access and any permissions needed from the property owner, occupant, or other authorized person. Please prepare the property before the appointment, inform us of known hazards and restrictions, secure pets, valuables, and sensitive information, and tell us about people who may be present. You are responsible for arranging the use of keys, entry devices, or access instructions.

We may pause or decline work where access is unavailable or conditions are unsafe. If a service cannot be completed, the cancellation and service-interruption provisions above apply according to the circumstances and applicable law. Our photographs, floor plans, and other media are marketing materials and are not a survey, appraisal, inspection, measurement certification, or guarantee of a property's condition or legal compliance.

6. Delivery and corrections

The order or quote will identify the deliverables, any delivery estimate or deadline, and included revisions. We will deliver completed media using the method identified in your order or delivery notice. Estimates are not guarantees unless the order expressly states a deadline as a commitment.

We provide access to the downloadable files we deliver, including any downloadable floor plans, for 12 months beginning when the completed media is first delivered, subject to the permitted suspension for overdue payment described in Section 2. A suspension does not change the date that period begins. Please download and keep your own copy during that period. The 12-month access period does not shorten your ongoing license to use copies you have retained under these Terms.

Interactive tours, interactive floor plans, and other products hosted by third parties are subject to the relevant provider's terms and the hosting period disclosed before you book. Access to those hosted products is not guaranteed for 12 months unless we expressly agree otherwise.

Contact us if you find a delivery error or a mistake we made in the agreed deliverables, such as a missing ordered image or an incorrectly delivered file. We will correct our mistakes without charge. Discretionary creative changes beyond the revisions included in your order, and other additional work outside the agreed scope, require an agreed quote before work begins.

7. Ownership and your license

Copyright in media remains with its actual rights holder. Depending on the work and applicable agreements, that may be Tide Point Media or another person or business. We grant the rights below only for media we own or are authorized to license. Your payment, receipt, or use of a file does not transfer copyright to you.

Once the order is paid in full, we grant the paying client a nonexclusive license, without a stated time or frequency limit, to use the delivered final media for marketing the same property and the client's own personal and business real estate marketing. Subject to the third-party restrictions below, the license includes a later listing of the same property by that same client. The client's brokerage and team members may use media to support that client's permitted marketing. The client may submit media through the client's brokerage, the applicable multiple listing service ("MLS"), and authorized listing portals, syndication services, and marketing providers as needed to support the client's permitted marketing, subject to their applicable rules. This permission does not allow edits without written permission or independent use by another agent or business.

Some media, including third-party tours or floor plans, may be subject to rights-holder or platform restrictions that limit their use or prevent reuse for a later listing. We will disclose known material restrictions before you book and any additional restrictions with the order or delivery. Applicable law and the accepted order govern any effect on rights already granted.

The MLS, authorized portals, and their distribution recipients may retain and use media under the rights properly granted to them and their applicable rules, including after a listing ends where those rights continue. A different agent, owner, seller, builder, stager, vendor, or other third party needs separate permission for its own independent use, unless the order expressly grants that use. This requirement does not restrict an MLS, authorized portal, or its distribution recipients from exercising rights properly granted to them. Contact us for additional licensing.

For portraits and headshots, the paying client receives an ongoing, nonexclusive license for the client's own personal and business marketing once the order is paid in full, subject to the rights and permissions applicable to any person depicted. A different person's or business's independent use requires separate permission unless expressly included in the order.

Please obtain our written permission before changing, editing, cropping, adding a watermark or text to, or otherwise modifying delivered media. Ordinary technical processing, such as compression or resizing needed to display otherwise unaltered media on an authorized platform, is permitted to the extent the platform's rules allow it. Any permission is subject to applicable platform rules and the rights of others. You are responsible for complying with the applicable MLS, brokerage, platform, and advertising rules when publishing media. We do not authorize changes that falsely represent a property or violate those rules.

8. Our portfolio and promotional use

Subject to the rights we hold and applicable law, we may use media from our work in our portfolio, website, social media, advertising, and other business promotion. These Terms do not provide a client opt-out from that use. Our use remains subject to any applicable rights or restrictions of the property owner, occupant, person depicted, creator, or other rights holder, including binding restrictions that apply to previously created work.

9. Materials you provide

You retain ownership of materials you provide to us. You authorize us to use them as needed to perform and deliver your order and represent that you have the rights and permissions necessary for that use. Please do not send sensitive financial information or government identification to our general email address.

Tell us about restrictions or permissions relevant to people, private information, artwork, music, logos, or other protected material that may appear in the project. Our ability to use a person's name, likeness, or other protected material remains subject to applicable rights and law.

10. Website use and content

You may use our website for lawful purposes. Do not interfere with its operation or security, attempt unauthorized access, introduce malicious code, impersonate another person, or use the website to violate another person's rights. Website content may be owned by us or licensed from others. Viewing the site does not transfer ownership or grant a license to copy, sell, publish, modify, or distribute its content beyond what the rights holder permits or applicable law allows. You may share links to public pages.

Our website may include links to services operated by others. Their terms and privacy practices apply to those services, and we do not control their availability. We work to keep website information accurate and available, but information may contain errors and access may be interrupted. To the extent allowed by law, general website content is provided as available without a promise that the website will always be uninterrupted or error-free. This does not alter an accepted service order or rights that cannot legally be waived.

11. Privacy

For questions about how we handle personal information, contact us at delivery@tidepointmedia.com.

12. Concerns, liability, and applicable law

If you have a concern about an order, please contact us at delivery@tidepointmedia.com so we have an opportunity to address it. This request does not prevent you from pursuing any available rights or remedies.

To the extent permitted by law, Tide Point Media's total liability arising out of or related to an order will not exceed the amount you paid for that affected order. This limit does not eliminate our obligation to provide refunds promised under these Terms or apply where applicable law prohibits it. Nothing in these Terms excludes a remedy or limits liability that cannot legally be excluded or limited. South Carolina law governs these Terms, subject to any mandatory law that applies to your transaction.

13. Changes and contact

We may update these Terms and post a new effective date. Updates apply prospectively to later orders and do not change the version accepted for an existing order unless you and we agree in writing or applicable law provides otherwise. If a provision is unenforceable, the remainder applies to the extent permitted by law.

Questions about the website, an order, these Terms, or privacy may be sent to delivery@tidepointmedia.com.
